DLA have received another successful appeal decision. This appeal was made against the Council of the London Borough of Enfield for their refusal for the proposed construction of a third floor under Class AA to provide two additional self-contained flats to an existing flat block.
Initially, the application was refused due to the impact on internal light and the potential for an allowed permission of this nature to go against an original condition as set out in the original grant of planning permission. In preparation to appeal the decision, we instructed Daylight Sunlight Consulting to carry out an internal day light study which demonstrated that a good level of daylight and sunlight would be retained in the proposed condition.
We also successfully argued against the previous condition issue in our Appeal Statement. The Inspector agreed with DLA’s arguments and the appeal was then allowed.
